SHERMAN - After slipping and falling in Target, an Ector County woman has filed a lawsuit against claiming that the store knew about the slippery substance on the floor, but did not clean it up.
Cynthia Fouche filed suit against Target Corp. on Feb. 12 in Denton County District Court. The defendant removed the case to Eastern District of Texas, Sherman Division on May 21.
The incident occurred on June 24, 2011, when Fouche was shopping at Target and stepped into a slippery substance on the floor of the aisle. She claims she fell backwards, hitting her head on the hard floor.
Fouche alleges she heard employees advising that the substance had been previously reported and discovered, but had not been cleaned up or removed. According to the lawsuit, there was no sign, barrier or other warning of the presence of the substances, which caused the Fouche’s fall.
The defendant is accused of negligence for failing to warn of the danger created by the substances on the floor, failing to place sufficient barriers in the area of the substance, and in allowing a dangerous condition to exist on its premises in the form of a slippery and a dangerous substance on the floor.
The plaintiff is seeking an award of damages for bodily impairment, incapacity, physical pain and mental anguish, medical expenses, loss of earning capacity, interest and court costs.
Fouche is represented by Odessa attorney Steve Brannan. A jury trial is requested.
U.S. District Judge Richard A. Schell is assigned to the case.
