Woman sues collection agency over unpaid medical bill

A Harris County woman has sued a medical practice group and its collection agency, alleging deceptive trade and debt collection practices in a billing dispute.

Sandra Perkins of League City filed suit Jan. 9 in Galveston County District Court against CHCA Clear Lake,  doing business as Mainland Medical Center of Texas City; NPAS, Inc., NPAS Solutions, National Patient Account Services Inc. and Parallon Business Solutions, alleging violation of debt collection law.

According to the complaint, Perkins received treatment Feb. 8, 2013 at the Mainland Medical Center Hospital in Galveston County and Mainland submitted a claim for the $1,750 bill to Perkins' health plan. Mainland was paid $221.93, and was informed that the remainder was ineligible due to deductible policy, the suit states.

According to the suit, Mainland attempted to collect the balance from Perkins from April through August 2013, then sent the bill to NCO Financial Systems Inc., a collection agency. Perkins directed NCO to communicate through her attorney, but NCO continued to send her bills and increased the total to $3,280.15, the suit states.

The complaint cites negative credit impairment, balance statements that included unreasonable fees, and that Mainland is harassing Perkins over invalid charges.

Perkins seeks declaratory and injunctive relief, damages, attorney fees and costs. She is represented by attorneys Bryan Pollard and Jessica Brown Wilson of FisherBroyles, Dallas.
