Trucker says he was injured while cleaning windshield

A Florida man is suing over claims he was injured while cleaning the windshield of his tractor-trailer when another driver allegedly backed into his vehicle.

Vladimir Kostov filed a lawsuit Oct. 30 in the Marshall Division of the Eastern District of Texas against Beckat Oil & Fuel and Daniel Fredrick, citing negligence.

According to the complaint, Kostov parked his tractor-trailer unit at the fuel pumps located at the Texas Best truck stop in Tyler on April 15, 2013, opened the hood of his tractor and climbed onto the engine to clean the windshield. The complaint states that at this time Fredrick parked a tractor-trailer owned by Beckat Oil in front of the plaintiff's and entered the store but after exiting the store, he got into his tractor-trailer and reversed into Kostov's vehicle.

Kostov says the collision caused the hood of his tractor to close onto him, knocking his head against the windshield and burning his left leg on the engine. Fredrick is accused of negligence, and Beckat Oil is being sued pursuant to respondeat superior.

Kostov seeks more than $75,000 in economic, non-economic and compensatory damages, including interest and costs of court.
