FedEx blamed for accident, injuries

A Texas man is suing over claims he was injured in a collision with a FedEx driver.

Kevin Walters filed a lawsuit Nov. 6 in the Marshall Division of the Eastern District of Texas against FedEx Corporation, FedEx Express Inc., FedEx Ground Package System Inc., FedEx Freight Inc., FedEx Custom Critical Inc., FedEx Trade Networks Trade Services Inc., FedEx Supplychain Systems Inc., Nell Enterprises, and Catherine and Michael Hoover, citing negligence.

According to the complaint, Catherine or Michael Hoover was driving a tractor and towing a trailer owned by the FedEx and Nell defendants westbound on Highway 75 (North Central Expressway) in Collin County on Nov. 14, 2012, when he or she failed to control the speed of the vehicle and struck the vehicle in front, causing it to strike the next vehicle, which Walters was driving.

Walters says he sustained injuries. The individual defendants are accused of negligence and negligence per se for failing to control the speed of the vehicle, and the company defendants are accused of negligence, negligent undertaking and negligent entrustment for failing to properly train its driver pursuant to respondeat superior.

Walters seeks more than $75,000 in damages, including medical expenses, loss of earning capacity, actual damages, interest and court costs. He is represented by attorneys Brent Goudarzi and Marty Young of Goudarzi & Young in Gilmer.
