Saleswoman alleges discrimination by employer

Discrimination

A woman has sued her employer, alleging violation of the Civil Rights Act for wrongful termination and associated issues.

Damaris Sevillano of Harris County filed a lawsuit Feb. 10 in the Houston Division of the Southern District of Texas, against HomePro Operating, doing business as HomePro Inc. of Carrollton.

According to the complaint, Sevillano was hired by HomePro, a provider of home security, entertainment and control systems, in November 2013 for an outside sales position.

Sevillano was to be paid a base salary plus commission and expenses, the suit states, but training exceeded the allotted time frame and was unpaid. Sevillano, who was born in Puerto Rico, alleges her manager made discriminatory remarks, denied her sales opportunities, criticized her accent and prohibited employees from reporting to human resources.

The suit states after that manager was transferred, Sevillano informed her new supervisor she needed time off to take her son to the hospital, but she was terminated in December 2013.

Sevillano seeks compensation for back pay, including overtime, damages for distress, attorney fees, expenses and costs. She is represented by attorney Lionel Martin of Garcia-Martin & Martin of Stafford.

Houston Division of the Southern District of Texas case number: 4:15-CV-00372.
