An Orange County resident has sued Allstate Insurance for alleged non-payment of benefits in a road incident.
Nathan Jerryd Sims filed a lawsuit Feb. 5 in Jefferson County District Court against Allstate Fire and Casualty Insurance Company, citing non-payment of benefits.
According to the complaint, Sims, an authorized operator of a 2002 Chevy Tahoe owned by Alvin Gardener, was driving the vehicle southbound on Avalon Avenue in Port Arthur, on April 4, 2014, when Anthony Wayne Jones, driving northbound, struck the plaintiff’s truck on the driver’s side, severely injuring the plaintiff. Jones failed to keep a lookout, maintain proper speed, brake and avoid collision, the suit states.
The suit says Sims filed a claim with Allstate but the defendant failed to respond. Sims alleges physical pain and suffering, loss of wages and lowered earning capacity.
Sims seeks between $200,000 and $1 million for damages, including medical expenses, attorney fees, expenses and costs. He is represented by attorney Lance Bradley of Bradley, Steele & Pierce in Port Arthur.
