Woman blames Chrysler for husband's death

A Nacogdoches County woman and her adult children have sued Chrysler Group, alleging for wrongful death in a 2013 accident.

Gloria Bennett, individually and as administrator for the estate of James Bennett, and John Paul and Melissa Bennett filed a lawsuit Jan. 30 against FCA US, formerly known as the Chrysler Group, in the Lufkin Division of the Eastern District of Texas.

According to the complaint, James Bennett drove his 2004 Dodge Ram 3500 truck to the family farm Feb. 18, 2013, and as he parked the car outside a gate, he assumed the truck was in park, and exited his vehicle to close an open gate. The truck moved in reverse, trapping and crushing him, killing him of asphyxiation, the suit states.

The suit says investigations confirm the truck’s tendency to fail to engage in park or reverse gear and that GM never informed Bennett of this supposed defect or of any safety recall. The complaint cites both manufacturing and marketing defects, breach of warranty, and wrongful death.

The Bennetts seek damages and compensation for the decedent’s pain and suffering, funeral expenses, attorney fees, expenses and costs. The plaintiffs are represented by attorneys Paul Smith, Tyler Henkel, and Avery Sheppard of Ware, Jackson, Lee & Chambers in Houston.
