On Monday a Beaumont judge reinstated a suit brought by Bridge City resident Darrell Charrier, who sued the motorist who allegedly struck him while he was walking on the side of a roadway.
As previously reported, the suit was filed Dec. 13, 2012, in Jefferson County District Court and names Leslie Peveto as a defendant.
Court records show Judge Milton Shuffield, 136th District Court, dismissed the case on Dec. 18, ruling that the case has been pending on the court’s docket for two years without final disposition.
On April 1 Charrier filed a motion to reinstate, asserting he never received notice that the case was on the court’s dismiss for want of prosecution docket.
Although no order of reinstatement was on file as of April 13, a court official told the Record the judge reinstated the case.
According to the lawsuit, on Dec. 21, 2010, Charrier was injured while walking on the side of a roadway when Peveto struck him with her vehicle.
The suit does not state where or how the incident occurred.
The suit accuses the defendant of negligently failing to provide the pedestrian with a warning of her intent and failing to wait to the pedestrian cleared the area.
The plaintiff is suing for his alleged past and future medical expenses, mental anguish, pain, impairment and lost wages.
