GALVESTON – A Texas man is suing over claims he was injured while tending to his boat on the shoulder of a highway when an intoxicated driver struck the boat.

Tyrone V. Parker filed a lawsuit Oct. 9 in Galveston County District Court against Brian Kisiel, citing negligence.

According to the complaint, Parker was tending to his boat, which was on a trailer, on the shoulder of Interstate 45 North on March 10, when a vehicle struck the boat, causing it to strike Parker. The driver of the vehicle was Kisiel, and he was driving while intoxicated, the lawsuit states.

Kisiel is accused of negligence, gross negligence and intentional infliction of emotional distress. Parker says he sustained injuries and the boat was rendered inoperable.

Parker is seeking damages, including medical expenses, loss of earning capacity, loss of the $30,000 boat, interest and court costs. He is being represented in the case by attorney Derrick D. King of Katy.

Galveston County District Court case no. 14-CV-1081.
