Albertson's shopper attributes injuries to falling box

A woman brought a lawsuit against an Idaho-based company for alleged negligence in 2014.

Katherine Kay Hurley filed against Albertson’s LLC of Boise in the Sherman Division of the Eastern District of Texas on May 18, claiming liability in a February 2014 incident.

The defendant, a subsidiary of SuperValu Inc. of Delaware and Eden Prairie, Minn., does business in Eastern Texas. Hurley was a customer of the defendant’s Denton, Texas store on Feb. 6, 2014. The court filing states that while she was bent over the meat counter, an employee came through the aisle behind her wheeling a dolly loaded with boxes.

According to the suit, one of the boxes fell off the dolly and struck the plaintiff, purportedly causing her back, shoulder, and neck damages and general bodily harm.

Citing significant, severe, disabling and permanent injuries, Hurley alleges pain, mental anguish; lost wages and earning capacity; physical impairment, disfigurement, and medical expenses.

The plaintiff seeks compensation in excess of $75,000 in damages; pre- and post-judgment interest; attorney’s fees; expenses and costs.

She is represented by attorney Edwin E. Wright III and Larry Sullivant of Sullivant, Wright & Brinkley in Gainesville.
