A Montgomery County resident filed a lawsuit against his jurisdiction’s county clerk claiming constitutional rights violation in the handling of a 2013 legal matter.
Leon Davis filed a grievance against Barbara Adamick in the Houston Division of the Southern District of Texas on June 9, claiming that jury selection for his case was flawed.
The suit states that Davis filed a motion challenging Montgomery County’s jury selection process, specifically faulting the lack of African-American representation among the selected jurors.
According to court documents, an expert demographer reviewed the county population and testified on May 21, 2014 that further investigation was necessary to determine if jury pools in the county are racially balanced.
The complaint claims that Adamick refused to disclose juror data to the plaintiff’s retained counsel. Davis alleges that he was deprived of his Sixth and Fourteenth Amendment rights and denied the right to be tried by a fair and impartial jury.
The nature of Davis’ case was not stated in the current suit.
Stating that he is not seeking monetary damages, Davis requests injunctive action ordering Adamick to provide addresses of all jurors summoned for duty during 2013 in electronic form and for all involved parties to sign confidentiality agreements.
