Pedestrian faults alleged inebriated driver for hitting him

A Beaumont resident filed a lawsuit against an allegedly inebriated driver, claiming negligence in a 2015 motor vehicle mishap that created major multiple medical problems for the plaintiff.

Howard Lee Land Jr. filed a complaint against Fernando Vargas in Jefferson County District Court on June 11, claiming liability in May automobile-pedestrian collision.

The suit states that Land was crossing Eastex Service Road in Jefferson County on or about May 25. According to the suit, the defendant was operating his vehicle and was intoxicated with a 12-year-old child in the car.

The complaint states that Vargas suddenly and without warning struck the plaintiff, leaving him no time to react and avoid impact with the vehicle. Land alleges negligence, maintaining that the defendant failed to keep a proper lookout, apply his brakes, take evasive action, slow or stop, and control his vehicle.

Land declares physical and mental pain and suffering, impairment and disability, scarring and disfigurement, and health care expenses.

The plaintiff seeks between $200,000 and $1 million in compensation for general and special damages, pre- and post-judgment interest; attorney’s fees; expenses, and costs.
