Man sues doc for separated sternum

A Louisiana man is suing a Port Arthur doctor for failing to properly reattach his sternum following bypass surgery.

Larry Deslatte filed the lawsuit against Dr. Saeed Ally on March 26 in Jefferson County District Court under Discovery Level III.

Deslatte entered Park Place Medical Center in Port Arthur in early January 2005 after experiencing episodic daily chest pain. Dr. Ally performed coronary bypass surgery on Deslatte, which involved using wire to close and reattach the plaintiff's sternum.

According to the plaintiff's original petition, about seven months after his release from the hospital the wire binding Deslatte's sternum together broke apart.

"Mr. Deslatte was told the sternum wires had pulled through the bone leaving the sternum separated. Mr. Deslatte has been advised he will have permanent repercussions as a result of the wires breaking," the petition states.

The plaintiff alleges that Dr. Ally was negligent and breached the standard of care for failing to wire the plaintiff's sternum, failing to use a sternum plate to hold the sternum together and failing to use other accepted methods to reattach the sternum.

Deslatte is seeking damages for past and future medical expenses, loss of wages and earning capacity, loss of household services, physical impairment, physical pain and suffering, mental anguish and other damages.

The plaintiff is requesting a trial by jury.

Michael Fuerst of Cypress, Texas, is representing the plaintiff.
