Suit filed from 2006 collision

Nathaniel Stephens is suing Ashleigh Petry for $50,000 over an auto collision he claims occurred when Petry "failed to control her speed."

Stephens filed his personal injury suit with the Jefferson County District Court on June 26. Judge Milton Shuffield, 136th Judicial District, has been assigned to the case.

According to the plaintiff's original petition, on Sept. 5, 2006, Stephens was traveling north on Concord toward the intersection of Cottonwood, "when Defendant Ashleigh Petry, driving a 1999 Buick Regal, failed to control her speed and collided with the rear of the Plaintiff's vehicle."

"The collision caused severe, painful, and disabling personal injuries to plaintiff," the suit said. "The collision was proximately caused by negligence of Petry.

As a direct and proximate result of the occurrence in question, the personal injuries suffered by Plaintiff have resulted in monetary damages in an amount within the jurisdictional limits of the court."

Stephens claims Petry was negligent for failing to maintain proper control of her vehicle, failing to timely apply her brakes, failing to take proper evasive action, failing to maintain a proper look out, failing to use the care of a reasonably prudent person in the operation of a vehicle, failing to travel at a safe rate of speed, and failing to stay alert.

Stephens is suing for physical pain and suffering in the past and future, mental anguish in the past and future, lost wages, loss of earning capacity, disfigurement in the past and future, physical impairment in the past and future, and past and future medical expenses.

He is demanding a trial by and is represented by attorney Timothy Ferguson of the Ferguson law firm.
