Breast cancer survivor sues after collision bursts implants

MARSHALL -- Breast cancer survivor, Karon Reagan of Anderson County was severely injured when her car was struck from behind by Head Leasing's employee, Ben Ellis, on June 20, 2006.

Reagan's severe injuries include a "traumatic brain injury and damage to her breast implants that were implanted after her successful bout with breast cancer."

On behalf of Karon Reagan, plaintiff's attorney Dick Swift from Palestine filed suit against Head Leasing, L.L.C and State Farm Mutual Automobile Insurance Company of Texas in the Marshall Division of the Eastern District of Texas on August 14.

According to the plaintiff's original complaint, Ben Ellis failed to control his vehicle resulting in the collision. The court records state that defendant Head Leasing failed to provide adequate driver and safety training and required Ben Ellis to work an unreasonable schedule.

Although Plaintiff was covered by underinsured insurance by State Farm, it is "not enough to cover all the plaintiff's damages."

The plaintiff seeks damages for medical expenses, mental anguish, physical pain and lost wages, which include the likely probability of her never returning to work. Damages sought exceed $100,000.

A jury trial is demanded with Judge John Ward presiding.
