F.J.T. Technical Resource Co. claims Lana Sepulvado and the Landmark Staffing Co. are planting lies about its business in order to lure away F.J.T.'s employees and customers.
F.J.T. filed a petition for an injunction against Sepulvado and Landmark with the Orange County District Court on Aug. 22.
According to the plaintiff's original petition, Landmark, whose sole officer is Sepulvado, has been doing business in the area for less than two years. However, on Landmark's Web site, the company says it "has been serving Orange County for over 17 years."
"(This is) a fraudulent lie on behalf of a company that was only incorporated on Jan. 25, 2006," the suit said. "Plaintiff has only become aware in the last few days the defendants are wrongfully and unlawfully soliciting and stealing plaintiff's employees and customers."
F.J.T. alleges Landmark is gaining ground in the market through spreading "fraudulent misrepresentations" about F.J.T.'s background and abilities.
F.J.T. claims Landmark is fictitiously telling people that its company is going out of business, is an out of town company and does not give its employees vacations, the suit said. "Plaintiff's employees and customers have believed such flagrant lies."
The company further claims the defendants' actions are costing F.J.T. around $1,000 a week.
In addition to the injunction, F.J.T. is suing for punitive and economic damages.
The plaintiff is represented by attorney Kerwin Stone of the Moore Landrey law firm.
The case has been assigned to the 128th Judicial District.
