Reckless drivers frequently face lawsuits for colliding with other cars, but a Bridge City couple is taking a woman to court for colliding with their house.
Michael and Patsy Joseph, individually and on behalf of minor Kenya Bragg, filed suit against Gloria Bankston on Oct. 3 in Orange County District Court.
According to the plaintiffs' original petition, on Aug. 24, 2006, the Josephs and Bragg were injured when a vehicle driven by Bankston crashed into their house in Bridge City. The suit does not describe the nature of the plaintiffs' injuries.
The plaintiffs allege that Bankston was negligent by failing to keep a proper lookout, control speed, maintain a safe stopping distance and apply brakes. She is also negligent for losing control of her vehicle, colliding with a house, driving in a negligent and harmful manner that would reasonably cause damage or harm to others and driving at a dangerous and high rate of speed.
Michael and Patsy Joseph are seeking compensation for physical pain, mental anguish, physical impairment, medical expenses, lost wages and earning capacity and medical expenses for Kenya Bragg.
Kenya Bragg is seeking compensation for physical pain, mental anguish and physical impairment.
The plaintiffs are asking the court to award punitive damages, interest, attorney fees and court costs.
