Not that fried chicken makes it on the list of health foods to begin with, but two Beaumont residents are alleging they became sick after purchasing and eating tainted chicken from Popeye's.
Andre Holloman and Olivia Hill have filed a personal injury suit against AFC Enterprises, doing business as Popeye's, in the Jefferson County Court at Law No. 1 on No. 29.
According to the plaintiffs' petition, on March 25, 2007, Holloman purchased some fried chicken from the Popeye's on Washington Blvd, "which (was) impure, adulterated, and otherwise unfit for human consummation."
"Later�that day the food products were eaten and consumed by the plaintiffs who later became seriously sick and ill causing them to have to seek medical attention at one of the local hospitals and experience pain and suffering�," the suit said.
The suit continues by alleging Popeye's was negligent for failing to properly prepare and inspect the food products sold to the plaintiffs, and for failing to warn the plaintiffs of the contaminated food products.
"The plaintiffs (were) caused to incur physical pain and mental anguish all to (their) damage and detriment in an amount exceeding the jurisdiction of this court for which (they) now sue," the suit said.
The plaintiffs are represented by the Law Offices of Woodson E. Dryden.
Judge Alfred Gerson has been assigned to the case.
