GALVESTON Ã¯Â¿Â½ An Angelina County woman went on vacation at a Galveston resort only to leave with lingering and excruciating pain as a souvenir, court documents say.
A complaint filed by Tammy Paulson of Pollock, claims Silverleaf Seaside Resort knew of the dangerous conditions that caused her to slip and fall.
Paulson filed a personal injury suit against Silverleaf Resorts Inc. and Silverleaf Seaside Resort on July 15 in Galveston County District Court.
Court papers say on July 4, 2007, Paulson was trying to negotiate some reportedly wet stairs when she fell.
"While on defendants' premises, plaintiff Tammy Paulson suffered from serious and permanent bodily injuries as a direct result of the dangerous conditions of defendants' floor, which defendants, its agents, servants, and employees knew or, in the exercise of ordinary care, should have known existed," the plaintiff's original petition states.
"Said plaintiff was an invitee to whom defendants owed a duty to use a high degree of care, including the duty to protect and safeguard said plaintiff from unreasonably dangerous conditions on the premises or to warn of their existence," court paper say.
The lawsuit generally accuses Silverleaf Resorts Inc. and Silverleaf Seaside Resort of negligence.
Paulson's complaint says both entities exhibited their negligence by:
"As a result of the negligent conduct of the defendants, plaintiff Tammy Paulson suffered severe bodily injuries to various parts of her body, in addition to bruises," the lawsuit said.
Paulson, who is represented by attorney Christopher Bradshaw-Hull, seeks damages including but not limited to loss of physical ability and medical expenses.
The case has been assigned to Judge David Garner of the 10th District Court.
