A Beaumont woman hit by a car in the parking lot of an H-E-B has filed suit against the vehicle's driver and the grocery store.
Alleging that the 11th Street store failed to post warning signs in its parking lot, Charisee Buxie filed suit against H-E-B on Aug. 4 in Jefferson County District Court. The suit also names the motorist who struck her, Justin Moore, as a defendant.
In her lawsuit, Buxie says she was walking through the parking lot at H-E-B when suddenly a vehicle driven by Moore "violently struck" her.
"At the time of the accident, defendant driver � Moore was operating his vehicle negligently � and failed to maintain proper lookout," the suit says.
The lawsuit goes on to allege H-E-B negligently failed to warn Buxie of the dangerous condition and supervise its premises.
Buxie is suing for exemplary damages, plus past and future mental anguish, lost earnings, disfigurement, impairment, medical expenses and loss of household services.
She is represented by Provost Umphrey attorney Matthew Matheny.
The case has been assigned to Judge Gary Sanderson of the 60th Judicial District.
