Subcontractor employee sues Total for injury at refinery

Craig Odom has filed suit against Total Petrochemicals USA, alleging he was injured while working for one of the company's subcontractors.

Odom claims he was working for A.S.G., a subcontractor of Total Petrochemicals when he received a severe, permanent and disabling injury on Sept. 30, 2006, according to a complaint filed Sept. 29 in Jefferson District Court.

Odom claims he suffered serious and permanent bodily injuries, physical pain, a loss of earnings, physical impairment and mental anguish "of an almost incalculable nature" as a result of a dangerous condition.

He also has become responsible for medical costs, according to the complaint.

Total Petrochemicals should have known about the condition and the likelihood of someone getting injured, the suit states.

Odom has received workers compensation benefits and medical benefits after the incident, but the suit will benefit Odom's employer's workers compensation carrier, the suit states.

The company was negligent because it failed to inspect the premises to discover the dangerous condition, failed to correct the condition, failed to furnish Odom with a safe place to work and failed to warn Odom that the dangerous condition existed, according to the complaint.

Odom claims Total Petrochemicals also failed to properly supervise.

He is seeking a judgment in excess of the minimum jurisdictional amounts, in addition to costs, prejudgment and post-judgment interest and other relief the court deems just.

The case has been assigned to Judge Bob Wortham of the 58th District Court.
