Men sue Motiva over injuries from oil dump

Two Jefferson County men and two Hardin County men have filed suit against Motiva Enterprises, claiming they were injured while working on the company's premises.

Thomas Ambriati, Lucan Jones, Anthony Phillips and John Coleman are employed by Standard Contracts and were working on the premises of the Motiva refinery on June 2 when they were injured after raw oil products were dumped after a shut down at the refinery, according to a complaint filed Nov. 14 in Jefferson County District Court.

As a result of the incident, the men claim they suffered physical pain and mental anguish, lost earnings, suffered damage to their earning capacity, disfigurement and physical impairment and incurred medical expenses.

Motiva was negligent because it failed to warn them of a dangerous condition, failed to keep the premises safe, failed to correct a dangerous condition, failed to provide a safe work place, failed to provide adequate safety equipment, failed to provide a reasonable warning about the condition and failed to institute adequate safety procedure, the suit states.

Ambriati, Jones, Phillips and Coleman are seeking unspecified damages, plus costs, interest and other relief the court determines appropriate.

The case has been assigned to Judge Gary Sanderson, 60th District Court.
