A League City man has filed an asbestos suit on behalf of his recently deceased father against Chevron, claiming the pulmonary asbestosis and lung cancer with which he was diagnosed was wrongfully caused.
David K. Landry claims his father Donnie G. Landry died from the disease Dec. 8, 2006, according to a lawsuit filed Dec. 3 in Jefferson County District Court.
Landry says his father worked for Gulf Oil, now Chevron, in facilities in Jefferson County, according to the lawsuit.
The plaintiff claims Chevron knew the products could cause asbestosis and asbestos-related cancers, but still allowed their employees to work near the products, according to the lawsuit.
He claims Chevron acted with malice and failed to timely and adequately warn workers of the dangers of asbestos.
Landry alleges Chevron failed to take the necessary precautions and to provide adequate warning and training to ensure that Donnie Landry was not exposed to the asbestos-containing products.
The plaintiff is seeking unspecified exemplary and punitive damages, plus interest at the legal rate, cost and other relief to which he may be entitled.
He is represented by J. Keith Hyde and D'Juana Parks of Provost and Umphrey Law Firm in Beaumont.
The case has been assigned to Judge Bob Wortham of the 58th District Court.
