35 companies sued over woman's alleged asbestos exposure

A Texas man has filed an asbestos suit on behalf of his recently deceased wife against 35 defendant corporations, claiming the asbestos-related disease with which she was diagnosed was wrongfully caused.

Chester A. Burgess Jr. claims Annie I. Burgess was exposed to asbestos through Chester's work as an insulator, according to a lawsuit filed Dec. 10 in Jefferson County District Court.

Chester claims the corporations were negligent because they failed to test their products.

The corporations also negligently failed to adequately warn of the dangers of asbestos exposure and continued to manufacture and distribute their asbestos-containing products after the hazards of asbestos were well known and documented, according to the complaint.

Because of Annie's death, Chester has suffered past physical pain, past and future mental anguish, past disfigurement, past physical impairment and has incurred medical costs and funeral bills, the suit states.

Chester is seeking unspecified exemplary and actual damages, plus pre- and post-judgment interest at the legal rate, costs and other relief to which he may be entitled.

He is represented by Bryan O. Blevins Jr. and Aaryn K. Giblin of Provost and Umphrey Law Firm in Beaumont.

The case has been assigned to Judge Gary Sanderson of the 60th District Court.
