A Jefferson County man has filed suit against Allstate County Mutual Insurance Co., alleging the company refused to pay for damages he sustained during an auto wreck.

Darrik Reynolds claims he was involved in an automobile collision with Ernest Lee Hicks II on Nov. 15, 2007, after Hicks failed to yield the right-of-way at the intersection of Texas 347 and Jimmy Johnson Boulevard in Port Arthur.

Hicks "suddenly and unexpectedly struck Plaintiff's vehicle in the front, causing the vehicle and trailer Plaintiff was pulling to jackknife and the boat to fall off of the trailer," the suit filed March 27 in Jefferson County District Court states.

Because of the collision, Reynolds says he sustained severe and permanent injuries to his back and incurred medical costs.

At the time of the collision, Reynolds had insurance through Allstate.

Before attempting to collect money from Allstate, Reynolds first tried to file a claim against Hicks. However, he learned Hicks had no insurance coverage.

Next, Reynolds filed a claim for his uninsured motorist protection benefits. But Allstate has failed to respond to Reynolds' claim, according to the complaint.

Reynolds is seeking an unspecified judgment, plus pre- and post-judgment interest, attorney's fees, costs and other relief to which he may be entitled.

The case has been assigned to Judge Milton Shuffield, 136th District Court.
