This Just In: Recent civil suits filed in Jefferson County District Courts

March 23

  • Beatrice Williams vs. Capitol County Mutual Fire Insurance Co.

    PA - Steve Mostyn, J - Bob Wortham

    The plaintiff is suing the insurance company for denying at least a portion of the plaintiff's Hurricane Ike policy claim.

    The plaintiff alleges the defendant is guilty of several Texas Insurance Code violations and of violating the DTPA.

    The plaintiff is suing for actual and consequential damages, plus attorney's fees.

  • Coy Joubert vs. Judy McLemore

    PA - Jonathan Juhan, J - Gary Sanderson

    On May 24, 2007, the plaintiff was traveling on FM 347 when the defendant allegedly failed to yield the right-of-way and slammed into the plaintiff.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

  • Debbie Jordan vs. Dr. Darryl Harris et al

    A Jefferson County woman has filed suit against Memorial Herman Baptist Beaumont Hospital and one of its doctors, alleging they failed to remove the placenta after she gave birth.

    Debbie Jordan claims that after she delivered a baby at the hospital on Jan. 8, 2007, her placenta was not completely delivered.

    The following day, Dr. Darryl Harris performed a tubal ligation on Jordan.

    However, during the procedure, the placenta was not detected and was still not removed, the suit states.

    After Jordan's discharge from the hospital on Jan. 11, 2007, she experienced weakness, sweating, abdominal pain and the passing of large blood clots, the complaint says. From time to time, she would also pass out.

  • Billy Terrell vs. Beaumont Methanol Corp. and Terra Industries

    In 1991, the plaintiff worked for DuPont when the company was acquired by the defendants. The plaintiff alleges the defendants wrongly refused to provide him with retirement benefits based on his total years of service when they laid him off.

    The plaintiff is suing for all the benefits he was allegedly denied during his employment, plus attorney fees.

  • Cynthia McVay vs. John Nobles

    A Beaumont woman and her son are suing their landlord, claiming they became ill due to mold growing in their home.

    They say they rented property from Nobles at 2220 Gladys Ave. in Beaumont and found mold all over the house after they moved in September 2006.

    The McVays reported the problem to Nobles, who promised to remedy it, the complaint says.

    However, the mold was never eradicated, and the McVays allege they became ill and suffered from respiratory problems.

    They also suffered severe physical and mental pain and anguish and incurred medical costs, the plaintiffs claim.
