Woman claims fall in hotel shower due to slippery surface

A Jefferson County woman and her husband have filed suit against a popular hotel chain and its manager, alleging the woman slipped in a shower because the hotel failed to provide a non-stick surface on its floor.

Theresa Summerlin and Ellis B. Summerlin say they spent the night at the Courtyard Marriott Brownsville in room 317 on June 17, 2007.

While taking a shower, Theresa Summerlin claims she slipped and fell, striking the floor and landing on her back.

Because of her fall, Theresa Summerlin claims she sustained serious and painful injuries that required medical attention and incurred medical expenses, according to the complaint filed June 18 in Jefferson County District Court.

She also suffered physical pain, mental pain and anguish, physical incapacity and impairment, the complaint says.

Courtyard Marriott Brownsville and its manager, John Hernandez, negligently failed to discover the dangerous condition, failed to apply non-slip decals and failed to warn the Summerlins of the dangerous condition, the suit states.

The Summerlins are seeking unspecified actual and punitive damages, plus interest at the highest legal rate, attorney's fees, costs and other relief the court deems just.

They will be represented by Brandon P. Monk of The Monk Law Firm in Port Arthur.

The case has been assigned to Judge Donald Floyd, 172nd District Court.
