  • Versey Richard vs.Voyager Indemnity Insurance Co.

    The plaintiff is suing the insurance company and several of its agents for denying at least a portion of the plaintiff's Hurricane Ike policy claim.

    The plaintiff alleges the defendant is guilty of several Texas Insurance Code violations and of violating the DTPA.

    The plaintiff, an elderly amputee, alleges he has suffered many problems and unnecessary hassles since becoming a customer of the defendant.

    He alleges his prosthetic leg has never fit right and has had to been worked on several times, inflicting upon him great mental anguish and pain, for which he now sues.

    On July 6, 2007, the plaintiff was traveling on Hwy. 69 in Lumberton when the defendant, who was driving erratically in the south bound lane, entered the north lane and struck the defendant head on.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.
