This Just In: Recent civil suits filed in Jefferson County District Courts

July 15

  • Jodine Coco vs. Mustafa Music and EJA Trucking

    PA - Brian Sutton, J - Bob Wortham

    On April 4, 2008, the plaintiff, an EJA Trucking employee, was operating her vehicle when she collided with a Mustafa vehicle.

    The suit does not state where or how the incident occurred and only alleges that "all the defendants were negligent."

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

  • Ella Hampshire vs. Ed Stewart Jr.

    PA - Jonathan Juhan, J - Bob Wortham

    On July 26, the plaintiff was traveling east on FM 105 when the defendant swerved into his lane and slammed into his vehicle.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

    On Dec. 16, 2008, the plaintiff was a passenger in a vehicle driven by the defendant. They were traveling northbound on the Eastex Freeway when the defendant rear-ended a driver stopped for a red light.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

  • Linda Duke et al vs. AO Smith Corp.

    PA - Bryan Blevins, J - Milton Shuffield

    On behalf of the estate of Atwood Taylor, the plaintiff is suing 40 corporate defendants, alleging the companies were responsible for inflicting her benefactor with an asbestos illness.

    Taylor, who already sued once and received a claim, worked as a pipefitter in Jefferson County.

    The suit alleges the defendants knew about the dangers of asbestos products but concealed the danger and conspired to sell, manufacture and use asbestos products.

    The plaintiffs are seeking punitive and exemplary damages.

  • Mark Meyers vs. Gulf Logistics

    PA - Francis Spagnoletti, J - Gary Sanderson

    On July 16, Spagnoletti filed a suit on behalf of Orange resident Mark Meyers. Meyers claims he was working on the Gloria A in August 2007 when he sustained severe and disabling injuries. The suit was filed against Gulf Logistics and Gulf Logistics Operating, owners of the Gloria A.

    No details about Meyers' injuries were given, and the unseaworthiness of the vessel is blamed for the incident.

    Plaintiff claims to have suffered physical pain, mental anguish, lost wages, impaired earning capacity, physical impairment and loss of ability to perform household services.

  • Thomas Ray Babin vs. Overhead Door Company of Beaumont

    On Oct. 24, 2007, the defendant was working on a boat house when he tore his shoulder cuff while attempting to raise a door.

    The door was installed by the defendant.

    The plaintiff alleges the defendant negligently failed to install and repair the door and is suing for physical pain, mental anguish, lost wages, impaired earning capacity, physical impairment and loss of ability to perform household services.

    On April 8, 2008, the plaintiff was a passenger in a vehicle being operated by the defendant traveling east on SH87 when the defendant hit a curb and slammed into a utility pole.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

    On behalf of Matthew Garrett, the plaintiff is suing CES for failing to protect him.

    The suit does not say for certain if Garrett was a CES employee.

    On Dec. 18, 2008, Garrett was working on one of the defendant's chemical domes when he suffered fatal asphyxia and poisoning due to hydrogen sulfide inhalation.

    The plaintiff is suing for her benefactor's lost wages and mental anguish.
