A Texas corporation says a company it contracted to help with a construction project failed to provide already paid-for the work and materials as promised.

Compro Event Center claims it hired Dennis Dickerson Construction, doing business as Action Construction, to help with the construction of Compro Event Center in Beaumont.

"Compro would show that Action breached the contract in several respects, including failure to man the work," the suit filed Aug. 11 in Jefferson County District Court states.

"Despite notice of such problems given to Action, Action nevertheless failed and refused to properly man the project and cure the other problems, and as a consequence, Compro terminated Action from the contract."

Subsequently, Compro hired another contractor to finish the work, but the cost to correct and complete Action's work exceeded the money left for Action's contract, according to the complaint.

"Therefore Compro sues Action for the excess amount which Compro had to pay to the completion contractor, in a principal sum in excess of $400,000," the complaint says.

In addition, Compro claims Action billed Compro for work and materials it did not provide, but Compro says it paid the bill.

Action also failed to pay subcontractors and suppliers when they were due, so Compro was forced to pay a certain portion of those bills, according to the complaint.

Compro is seeking actual damages, plus attorney's fees, costs, pre- and post-judgment interest at the maximum extent allowed by law and other relief to which it may be entitled.

The case has been assigned to Judge Milton Shuffield, 136th District Court.
