GALVESTON - A Harris County man is suing a couple of construction companies for injuries he reportedly sustained from a fall at a job site four months ago.

Marlon Flores's personal injury lawsuit says Remington Homes Inc. and ROC Commercial Builders LLC neglected to supervise the plaintiff as he worked on a residence in Friendswood's Polly Ranch subdivision.

"The plaintiff will show that because of the relationship of the defendants, the defendants are jointly and severally liable for the incident in question and the plaintiff's resulting injuries and damages," the original petition says. "In this connection, the defendants were agents of one another."

"The plaintiff will also show that the defendants controlled and/or had the right of authority to control the construction site, including safety issues related to the construction."

The suit was filed Sept. 14 in Galveston County District Court.

Flores explains that on May 7, 2009, he was installing siding on a townhouse undergoing renovation when he slipped off the roof and landed on the balcony below.

Court papers are mum on the extent of Flores's injuries though they claim that the plaintiff experienced pain and suffering, impairment, disfigurement, and mental anguish.

The plaintiff additionally argues that the defendants violated many OSHA regulations prior to and at the time of the alleged incident.

"Such violation was also a proximate cause of the plaintiff's incident and resulting injuries and damages," the suit says.

It also implicates an agent with defendant ROC.

Plaintiff Flores, who is represented by Friendswood attorney Michael G. Martinez, seeks undisclosed monetary damages and a jury trial.

Galveston County 56th District Court Judge Lonnie Cox is presiding over the case.
