A company is alleging another Texas company is stealing its clientele by using a nearly identical name.

DSF Advanced Staffing, doing business as Advanced Staffing Inc., filed a lawsuit Sept. 15 in Jefferson County District Court against Advance Staffing and Training Services, Fredericka J. Young and Jacqueline L. Franklin.

In its lawsuit, DSF is asking the court to place an injunction on the defendants to prevent them from using a name that DSF claims is too similar to its own.

"In this regard, Plaintiff would show that Defendants' use of this name is substantially similar to Plaintiff's lawful trade name, and causes substantial confusion and disruption in the marketplace, as well as irrevocable loss of goodwill and clients that belong to the Plaintiff," the suit states.

"If this conduct continues unabated, Plaintiff will continue to suffer substantial injuries for which there can be no adequate, subsequent redress in a court of law."

DSF's allegations against the defendants include negligence.

In addition to the injunction, DSF is also seeking actual and punitive or exemplary damages, plus other relief to which it may be entitled.

John S. Morgan of Harris, Duesler and Hatfield in Beaumont will be representing it.

The case has been assigned to Judge Gary Sanderson, 60th District Court.
