A man claims he was struck by a driver who drove straight instead of turning, even though he was in a turn-only lane.
Herbert Balance claims he was driving on the Interstate-10 Service Road on Oct. 19, 2007, when defendant David R. Khan, who was driving a vehicle for co-defendant A.Q.A. Trucking, attempted to go straight from a turn-only lane and "slammed" into Balance's vehicle.
According to the complaint filed Sept. 18 in Jefferson County District Court, the collision caused Balance to incur medical expenses and to lose earnings and his earning capacity.
In addition, he suffered physical impairment, physical pain and mental anguish, incurred property damage and sustained disfigurement, the suit states.
Khan was guilty of negligence, the complaint says.
Balance is seeking an unspecified judgment, plus interest, costs and other relief to which he may be entitled.
He will be represented by Jonathan C. Juhan of Beaumont.
The case has been assigned to Judge Donald Floyd, 172nd District Court.
