This Just In: Recent civil suits filed in Jefferson County District Courts


Nov. 20

  • Sharon Zerko vs. Regency Nursing and Rehabilitation Centers

    PA - Clay Dugas, J - Milton Shuffield

    In the midst of the chaos during the evacuation of Hurricane Ike in September 2008, Cindy Zerko fell out of her wheel chair and fractured her hip.

    Two weeks later, Zerko died.

    Now her daughter, Sharon Zerko, is suing the Regency Nursing and Rehabilitation Centers, alleging the senior center negligently failed to "to initiate an effective fall prevention program."

    The plaintiff is suing for wrongful death damages.

  • Betty Lou vs. Chevron USA

    PA - Keith Hyde, J - Donald Floyd

    A widow has filed suit against Chevron USA, alleging the oil giant negligently exposed her late husband, Billy Cunningham, to asbestos and inflicted him with mesothelioma.

    Provost Umphrey attorney Keith Hyde filed the personal injury lawsuit on Betty Lou's behalf.

    "During Cunningham's employment with Gulf Oil, he used and was exposed to toxic materials including asbestos dust and/or fibers," the suit said. "As a result of such exposure, he developed an asbestos-related disease, mesothelioma, for which he died a painful and terrible death on Feb. 11, 2009."

    The suit alleges that the oil conglomerate knew for decades that asbestos-containing products could cause the disease asbestosis and other asbestos-related cancers but still allowed its employees to work with and around the naturally occurring mineral.

    The plaintiff is suing for exemplary damages.

  • Thomas Gilchriest et al vs. Fire Insurance Exchange

    PA - Steve Mostyn, J - Donald Floyd

    The plaintiff is suing the insurance company and several of its agents for denying at least a portion of the plaintiff's Hurricane Ike policy claim.

    The plaintiff alleges the defendant is guilty of several Texas Insurance Code violations and of violating the DTPA.

    The plaintiff is suing for actual and consequential damages, plus attorney's fees.

  • Tilden Boudreaux vs. Lewis Markes and Industrial Services et al

    PA - Langston Adams, J - Milton Shuffield

    On Sept. 24 the plaintiff was traveling on Hwy 73 when the corporate defendant's truck driver rear-ended him.

    The plaintiff alleges the defendant driver negligently failed to keep a proper lookout and is suing for past and future mental anguish, pain, impairment, lost wages and medical expenses, plus attorney's fees.

    The plaintiff is suing the insurance company and several of its agents for denying at least a portion of the plaintiff's Hurricane Ike policy claim.

    The plaintiff alleges the defendant is guilty of several Texas Insurance Code violations and of violating the DTPA.

    The plaintiff is suing for actual and consequential damages, plus attorney's fees.

  • Naomi Carter vs. Fire Insurance Exchange

    The plaintiff is suing the insurance company and several of its agents for denying at least a portion of the plaintiff's Hurricane Ike policy claim.

    The plaintiff alleges the defendant is guilty of several Texas Insurance Code violations and of violating the DTPA.

    The plaintiff is suing for actual and consequential damages, plus attorney's fees.

  • Patrick Sinegar et al vs. Supreme Auto Transport et al

    The plaintiff is suing on behalf of Marlon Shedrick, who on Feb. 9, 2008, was a passenger in a vehicle that struck one of the defendant's trucks parked on US 69.

    The plaintiff is suing for wrongful death damages.
