An Orange County woman says she suffered physical pain and mental anguish after a driver rear-ended her, causing her to be pushed into the car in front of her.
Peggy Sue Free filed a lawsuit Jan. 8 in Jefferson County District Court against Kelly Beth Jones.
Free claims she drove her 2003 Honda Civic in the right eastbound lane of Dowlen Road in Beaumont on Jan. 18, 2008. At about 7:09 p.m. she brought it to stop behind a Chevrolet Trailblazer stopped at a red light at the intersection with Old Dowlen Road. Suddenly, Jones slammed into the rear of Free's vehicle, the complaint states.
"The impact was so forceful it caused plaintiff's vehicle to impact the rear of the vehicle directly in front of plaintiff's vehicle," the suit states.
Because of the accident, Free suffered physical pain and mental anguish, incurred medical costs, suffered physical impairment and lost wages, the complaint says.
Free blames Jones for causing the accident, saying Jones negligently failed to keep a proper lookout, failed to timely apply her brakes, failed to maintain proper control of her vehicle, failed to control her speed and failed to maintain a clear distance.
Free seeks an unspecified judgment, plus pre- and post-judgment interest, costs and other relief the court deems just.
Larry C. Hunter of Hunter Burch in Vidor will be representing her.
The case has been assigned to Judge Milton Shuffield, 136th District Court.
