Green Tree Servicing has filed suit against a Jefferson County man who it says defaulted on a manufactured home retail installment contract.

Green Tree Servicing claims Wilbert J. Young entered into the contract on Feb. 22, 2005. It was secured by a security interest in a 1998 Fleetwood Manufactured Home, according to the complaint filed Jan. 29 in Jefferson County District Court.

However, Young defaulted on the contract, so Green Tree accelerated the remaining balance of the contract, the suit states.

"As of Jan. 21, 2010, after all just and lawful offsets there was due and owing, the amount of $51,654.36 in principal and interest, with interest continuing to accrue from that date until the date of Judgment at the rate of $9.08 per day," the complaint says.

Because Young defaulted on the contract, Green Tree says it is entitled to the manufactured home, which was used as a security interest.

In addition to the money and property it says it is owed, Green Tree is seeking actual damages, plus pre- and post-judgment interest, attorneys' fees and other relief the court deems just.

Richard A. McKinney and Daniel Paz of Higier, Allen and Lautin in Addison will be representing it.

The case has been assigned to Judge Donald Floyd, 172nd District Court.
