A man has filed suit against his employer after he says he was injured while working at a grocery store.
Donato Arce claims he was injured while working for Retail Investors of Texas doing business as Mercado de Familia.
Arce does not specify how he was injured, but said Mercado de Familia does not carry workers' compensation insurance, and therefore is responsible for all of Arce's injuries.
According to the complaint filed Feb. 10 in Jefferson County District Court, because of his injury, Arce incurred medical costs and experienced pain and suffering. In addition, he lost income and experienced mental anguish, the suit states.
Arce balmes Mercado de Familia for causing his injuries, saying the company had actual knowledge of the dangerous condition on its premises, knew that the dangerous condition posed an unreasonable risk of harm to its employees, failed to eliminate the dangerous condition and failed to reduce the risk of harm to Arce.
Arce is seeking an unspecified judgment within the jurisdictional limits of Jefferson County District Court.
John S. Morgan of Harris, Duesler and Hatfield in Beaumont will be representing the plaintiff.
The case has been assigned to Judge Gary Sanderson, 60th District Court.
