Louisiana resident wants $1.25 million over rear-end collision in Texas

LUFKIN -- A Louisiana man who claims he was rear-ended when he slowed down for a broken down school bus is seeking $1.25 million from the driver and his employer.

Frank Lloyd claims he was being a courteous driver when he slowed his vehicle as he approached a school bus on the side of the road with its emergency lights flashing.

As he slowed, Lloyd alleges he was rear-ended by a truck's inattentive driver.

Lloyd filed a personal injury lawsuit against the truck's driver, Matthew Franklin, and Franklin's employer, Roberts Farms, on Feb. 22, in the Lufkin Division of the Eastern District of Texas.

Franklin was driving a vehicle for Roberts Farms at the time of the collision.

The suit states that Lloyd was southbound on Highway 259 in Nacogdoches County on March 27, 2009, when he slowed his vehicle as he approached the stranded school bus. The plaintiff states he was injured solely due to the negligence, fault or inattention of Franklin.

Lloyd claims Franklin violated highway safety laws and is negligent for failing to control the speed of his vehicle, driving at an unsafe speed, failing to maintain proper lookout, failing to avoid striking Lloyd's vehicle and for striking the plaintiff's vehicle.

The plaintiff is seeking damages for property damage, physical impairment, disfigurement, loss of earning capacity, pain and suffering, mental anguish, medical expenses, loss of household services and prejudgment interest.

Jury trial requested.

Lufkin attorney George Chandler of Chandler, Mathis and Zivley is representing the plaintiff.

U.S. District Judge Marcia A. Crone is assigned to the case.
