Woman sues TxDot for not building better road

By David Yates | Mar 24, 2010

An Orange resident has filed suit against a truck driver who ran a red light and hit her, the company the driver works for and the Texas Department of Transportation for not building a safer road.

Tara Hendrix filed the suit against Davies Construction, Brian Bellard and TxDot on March 9 in Orange County District Court.

Court papers show that on Feb. 8 Bellard, a Davies Construction truck driver, disregarded a traffic control signal and entered Highway 62, striking Hendrix's vehicle.

In her suit, Hendrix is alleging that Bellard negligently failed to yield the right-of-way and Davies Construction was negligent in its hiring and training of Bellard.

The suit also asserts TxDot "had a duty to design and construct the roadway and intersection in question using ordinary care.

Hendrix is suing the company for past and future medical expenses, mental anguish and lost wages.

She is represented by Beaumont attorney Clay Dugas.

The case has been assigned to Judge Dennis Powell, 163rd Judicial District.

Case No. B100107-c
