Suit: Car pulled out of Wal-Mart parking lot, struck woman's vehicle

A Beaumont woman has filed suit against the driver of the vehicle she says struck her as it attempted to turn out of a Wal-Mart parking lot.

Ingram Livings claims she was driving south on Old Dowlen Road when defendant Darel H. Hollinhead attempted to enter Old Dowlen Road from the Wal-Mart parking lot and struck her.

Because of the collision, Ingram Livings, and minor Destiny Livings who was also riding in the vehicle at the time of the collision, experienced physical pain, suffering, mental anguish and physical impairment; and incurred medical costs, according to the complaint filed March 29 in Jefferson County District Court. In addition, Ingram Livings lost her earning capacity and lost the services of her daughter, Destiny Livings, the suit states.

Hollinhead neglgiently failed to timely apply his brakes, failed to maintain a proper lookout, failed to drive the vehicle in a safe manner, failed to maintain control of the vehicle, failed to take evasive action and failed to yield the right-of-way, the complaint says.

Livings is seeking an unspecified judgment, plus interest, costs and other relief the court deems just.

The case has been assigned to Judge Milton Shuffield, 136th District Court.
