GALVESTON - New Orleans-based Ardent Services LLC's lawsuit against Galveston Bay Biodiesel LP seeks to recover $19,408.98 for incomplete Hurricane Ike-related repairs.

According to a breach of contract lawsuit filed April 6 in Galveston County District Court, the plaintiff and the defendant entered into a contract on Oct. 13, 2008, exactly one month after the Category 2 storm made landfall on Galveston Island.

Ardent Services was to supply certain labor and materials as ordered by the defendant for the project on a time and material basis. Galveston Bay Biodiesel was to pay the plaintiff for labor and materials invoiced and accepted no later than the 30th day after they were supplied, delivered and invoiced in accordance to the contract.

The suit insists that the plaintiff fully performed its contractual obligations, but the defendant had failed and refused to pay despite written demand.

In addition to the $19,408.98 in question, Ardent Services seeks attorney's fees and interest.

Dallas attorneys Brad W. Gaswirth and Andrea A. Hight are representing the plaintiff, and Galveston County 10th District Court Judge David Garner is presiding over the case.
