Woman sues over rear-end collision

A Jefferson County woman claims she incurred medical costs after a driver rear-ended her vehicle.

Jamie L. Cole filed a lawsuit April 14 in Jefferson County District Court against Richard S. Morris and Raiford Motors, doing business as Energy Country Ford Lincoln Mercury.

Cole claims she drove a 2004 Hyundai Elantra in the 5000 block of Highway 69 in Jefferson County on April 29, 2008, when Morris, who drove a Ford Fusion owned by Raiford, failed to control his speed and struck her.

In addition to the medical costs she incurred because of the collision, Cole experienced physical pain, suffering, mental anguish and physical impairment and lost earnings, according to the complaint.

She blames Morris for causing the accident, saying he negligently failed to keep a proper lookout, failed to timely apply his brakes, failed to keep a safe distance between vehicles, failed to pay attention, failed to turn his vehicle in an attempt to avoid a collision and drove at an unsafe speed.

Cole seeks a judgment within the limits of Jefferson County District Court, plus pre-judgment interest at the maximum rate allowed by law, post-judgment interest at the legal rate, costs and other relief to which she may be entitled.

The case has been assigned to Judge Bob Wortham, 58th District Court.
