Galveston couple claims home unrepaired despite contract

GALVESTON - A Galveston couple has filed a $60,000 deceptive trade lawsuit against a home builder after their storm-damaged home sat idle despite the company's promises of completed repairs in a month's span.

Florence and Enrico Duru claim that they paid Calibre Homes Corp. $85,000 to perform work on their West End residence, which was damaged during Hurricane Ike in early September 2008.

The suit was filed May 4 in Galveston County District Court.

The Durus argue they and Calibre entered into a contract on Dec. 13, 2008, with the defendant agreeing to finish the project by Jan. 12, 2009.

Calibre submitted a change order to the couple about six months later that the plaintiffs claim they did not request.

"At the time of the presentation of the change order, the plaintiffs' home was not complete; there was no water in the home, no electricity, and the plaintiffs continued to incur expenses," the original complaint states.

In addition to the specified monetary damages, a jury trial is demanded.

Attorney Anthony P. Griffin of Galveston is representing the plaintiffs, and Galveston County 56th District Court Judge Lonnie Cox is presiding over the case.
