A woman has filed suit against the driver who she claims rear-ended the vehicle in which she was riding.

Betty Sue Finley claims she was riding in a vehicle that was stopped for traffic on Interstate 10 in Beaumont on May 20, 2008, when suddenly Howard Stewart Logan, who was driving a vehicle for Petroleum Solutions, caused a rear-end collision.

Because of the accident, Finley sustained serious and disabling injuries to her neck, back and body; incurred medical costs; experienced physical incapacity, physical pain and suffering, physical impairment and incapacity and mental anguish; and lost her enjoyment of life, according to the complaint filed May 18 in Jefferson County District Court. In addition, she suffered personal inconvenience, the suit states.

Logan negligently drove too fast, failed to keep a proper lookout, failed to timely apply his brakes, failed to take evasive action, failed to yield the right-of-way, failed to turn to either the left or right to avoid a collision and failed to control his speed, the complaint says.

Finley also places some of the blame for the collision on Petroleum Solutions, which she claims negligently entrusted a vehicle to an unqualified driver, allowed an incompetent driver to use her vehicle, failed to employ a safe and competent driver, failed to properly train its employees and failed to properly instruct its employees.

In her complaint, Finley is seeking actual, punitive and exemplary damages, plus costs, pre- and post-judgment interest and other relief the court deems just.
