GALVESTON - A Galveston County man seeks $35,000 from HEB Food Stores Inc. over a fall he had at the company's Hitchcock store two years ago.
James Powers claims he tripped and fell as he walked on a rug while on the defendant's premises on May 21, 2008.
"The condition of the premises posed an unreasonable risk of harm in that the rug on the floor of the defendant's store created a continuing risk of injury and a tripping hazard to customers such as the plaintiff," the original complaint says.
The suit was filed May 18 in Galveston County District Court.
Powers argues that he hurt his knee, back and neck and sustained physical pain and suffering, mental anguish, lost earnings and incurred medical expenses.
Attorney Von H. Shelton is representing the plaintiff, and Galveston County 10th District Court Judge David Garner is presiding over the case.
