A Colorado man has filed suit against Bruce D. Bosworth, the U.S. Small Business Administration and the unknown heirs of Bruce D. Bosworth, alleging the lien Bosworth placed against his property should be lifted.

Plaintiff Ricardo Nava of 4833 Front St. in Castle Rock, Colo., claims he owns property at lots 11 and 12 in the Rosemont addition of Port Arthur as described in a warranty deed dated May 24, 2004.

On July 24, 2006, however, Bosworth filed and recorded a deed of trust purporting to create a lien on the property, according to the complaint filed May 27 in Jefferson County District Court.

"The Deed of Trust by Bruce D. Bosworth constitutes a cloud on Plaintiff's title," the suit states. "Though the name of the purported Grantor, Bruce D. Bosworth, appears valid on its face, it is invalid and unenforceable as the purported Granotr, Bruce D. Bosworth does not own any interest in the subject property, and had no authority to otherwise encumber the property."

The case has been assigned to Judge Milton Shuffield, 136th District Court.
