Motorist sues after being rear-ended while stopped at red light

A man has filed suit against the driver who he claims crashed into the rear of his vehicle as he sat at a red light.

Steven Wistner claims he was stopped at the light facing southbound in the 5600 block of Texas Highway 347 in Port Arthur on Nov. 21, 2009, when defendant Michael Barran, who was also traveling south, collided with the back of his vehicle.

Because of the collision, Wistner incurred medical costs; experienced physical pain, mental anguish, suffering, disability, loss of enjoyment of life and physical impairment; and lost wages, according to the complaint filed May 27 in Jefferson County District Court.

Barran negligently failed to properly apply his brakes, failed to keep a proper lookout, failed to keep control of his vehicle, drove in a negligent and unsafe manner and drove inattentively, the suit states.

In his complaint, Wistner seeks a judgment within the minimum jurisdictional limits of Jefferson County District Court, plus costs, pre- and post-judgment interest and other relief to which he may be entitled.

Clay Dugas and Mike Jacobellis of Beaumont will be representing him.

The case has been assigned to Judge Gary Sanderson, 60th District Court.
