A Jefferson County man has filed suit against the driver who he claims suddenly pulled in front of him.

Gerrick A. Marsh claims he was driving east on College Street on July 3, 2008, when defendant Donald W. Dorn suddenly pulled in front of him and struck his vehicle.

"Defendant, Donald W. Dorn for reasons unknown to this Plaintiff, wholly failed to observe Plaintiff's vehicle thereby causing this Plaintiff to sustain serious, permanent, and painful personal injuries and damages as hereinafter set forth," the suit filed June 16 in Jefferson County District Court states.

In addition to his injuries, Marsh suffered physical pain and mental anguish, endured physical impairment, incurred medical costs, lost his enjoyment for life and lost earnings, according to the complaint.

He blames Dorn for causing the collision, saying Dorn negligently failed to maintain a proper lookout, failed to maintain proper control, failed to timely apply his brakes, failed to drive at a speed greater than a normal person would have used under similar circumstances, failed to turn his vehicle to avoid a collision, failed to yield at an intersection and drove without due regard for the rights of others.

In his complaint, Marsh is seeking an unspecified judgment, plus pre-judgment interest, costs and other relief the court deems just.

The case has been assigned to Judge Donald Floyd, 172nd District Court.
