Driver sued for allegedly failing to yield at intersection

In a recently filed lawsuit, a Jefferson County man accuses a driver of causing an accident after refusing to yield at an intersection.

Jason Shuck filed a lawsuit June 18 in Jefferson County District Court against Charles Monroe and Angela Hines.

Shuck claims he drove in Jefferson County on Nov. 16, 2008, when a vehicle operated by Monroe and owned by Hines stuck him at an unspecified intersection.

Because of the collision, Shuck incurred medical costs; experienced physical pain, suffering and mental anguish; lost his earnings; sustained physical impairment; and incurred property damages, according to the complaint.

He blames Monroe for causing the collision, saying Monroe negligently failed to keep a proper lookout, failed to maintain control of the vehicle, drove too fast, failed to apply his brakes in a timely manner, failed to exercise ordinary care, failed to turn to avoid a collision, failed to keep the proper distance between his vehicle and Shuck's, failed to yield to Shuck, failed to stop in obedience with a traffic signal and failed to proceed in the intersection only when it could safely be accomplished.

Hines negligently entrusted her vehicle to Shuck, a reckless and incompetent driver, the suit states.

In his complaint, Shuck seeks a judgment in excess of the minimum jurisdictional limits, including exemplary damages, plus costs, pre- and post-judgment interest and other relief the court deems just.

B. Adam Terrell of Weller, Green, Toups and Terrell in Beaumont will be representing him.

The case has been assigned to Judge Donald Floyd, 172nd District Court.
