A Beaumont woman is asking the Jefferson County District Court to allow her out of a contract after the other party failed to fulfill its obligations.
Amelia Alexander filed suit against Extraordinary Accents on July 23 in Jefferson County District Court.
The original contract between the parties was executed on June 9, 2009, and called for the removal of debris and renovation of the property located at 230 Cherry, Bridge City.
The contract stated that upon completion of the work, Alexander would transfer the deed to another piece of property located at 495 E. Young, Bridge City, to Extraordinary Accents. The contact also stated that if Alexander defaulted she would be assessed $29,000 in liquidated damages.
Less than a month later the contract was modified to require Extraordinary Accents to also renovate property located at 3782 Fishook, Bridge City.
Alexander states the defendant failed to renovate either property and has therefore breached the agreement. She has provided notice to the defendant of the breach and states the defendant refuses or is unable to complete the contracted repairs.
Alexander is asking the court to terminate the agreement between the parties and excuse her from her obligations under the contract or subsequent modification.
